I just separated from my husband recently. He holds the house and wants to refinance the mortgage, which is in both of our names, but I don't want to because I am no longer living there. How do I handle this so that I can prevent him from having my credit checked?

A woman has won a legal victory that will benefit thousands of others who have broken up with their partners.

But a judge has ruled that Elayne Oxley has a right to a portion of the home she lived in with her estranged partner - even though she did not pay the mortgage - because of her contribution to running the household.
